NEW REGULATIONS PROPOSED FOR NONSUBSCRIBING EMPLOYERS
Texas Department of Insurance Division of Workers' Compensation (TDI-DWC) is working to change nonsubscriber reporting requirements that relate to the notice of coverage status, termination of coverage, occupational injuries and the requirement that Texas nonsubscribers must notify employees of their coverage status. Changes related forms, (DWC Form-005 and DWC-007) are also informally proposed.
TDI-DWC reports that employer compliance with the requirement to file the DWC Form-005 is less than 10%.
In 2011, TDI-DWC announced it was stepping up enforcement actions against Texas nonsubscribers that failed to comply with state reporting requirements. Administrative fines of up to $25,000 per day can be assessed for each reporting violation.
The Texas Association of Responsible Nonsubscribers (TXANS) will provide an overview of the new proposals at its TXANS 22nd Annual Nonscbscriber Conference and Exhibition on March 21/22 2012.
