NONSUBSCRIBERS REQUIRED TO PROVIDE WRITTEN NOTICE TO EMPLOYEES
Notice of nonsubscriber status must be provided to employees (in writing) in two different scenarios. First, at the time of initial election--the time the employer notifies the workers' compensation insurance carrier that the employer is dropping workers' compensation insurance coverage (if there will be a period during which employees will not be covered by workers' compensation insurance). Employers must also provide written notice at the time each new employee is hired. The "time each new employee is hired" means "when the employee is required by federal law to complete both a W-4 form and an I-9 form or when a break in service has occurred and the employee is required by federal law to complete a W-4 form on the first day the employee reports back to duty."
