07/30/2014 -- GOV. PERRY APPOINTS NEW COMMISSIONER OF WORKERS' COMPENSATION

Gov. Rick Perry has appointed Ryan Brannan of Austin as commissioner of Workers' Compensation at the Texas Department of Insurance (TDI), effective Aug. 1, 2014, for a term to expire Feb. 1, 2015.

Texas commissioner of workers' compensation, Rod Bordelon announced his resignation effective August 1.


04/17/2014 -- TDI APPROVES UPDATE TO TEXAS NONSUBSCRIBER TO WORKERS' COMP STUDY

Texas commissioner of insurance Julia Rathgerber has adopted the FY 2014 Research Agenda for the Workers’ Compensation Research and Evaluation Group at the Texas Department of Insurance.


03/25/2014 -- TXANS ANNOUNCES PROGRAMS FOR 24TH ANNUAL NONSUBSCRIBER CONFERENCE & EXHIBITION

The Texas Association of Responsible Nonsubscribers has announced programs for TXANS 24th Annual Nonsubscriber Conference & Exhibition. TXANS 2014 Nonsubscriber Conference & Exhibition is planned for April 30-May 1, 2014 in Austin, Texas.

TXANS conference is the oldest and most comprehensive event to focus on the needs of employers who operate as nonsubscribers to workers’ compensation in Texas.


01/22/2014 -- FILING DEADLINE APPROACHES FOR NONSUBSCRIBERS TO WORKERS' COMPENSATION

Texas employers who operate as a nonsubscriber to workers’ compensation system and whose employees are not exempt from coverage under the Texas Workers’ Compensation Act must file a DWC Form-005--Employer Notice of No Coverage or Termination of Coverage—between February 1 and April 30 of each calendar year.


11/26/2013 -- OKLAHOMA UPDATE: SUPREME COURT AGREES TO CONSIDER CONSITIUTIONALITY OF NEW WORKERS COMP & OPT OUT LAW

The Oklahoma Supreme Court yesterday agreed to hear oral arguments in a case that challenges the constitutionality of Oklahoma's new workers' compensation law.


09/19/2013 -- LAWSUIT CHALLENGES NEW OKLAHOMA WORKERS COMP AND OPT OUT LAW

Two legislators and a state firefighter's association have filed a lawsuit challenging Senate Bill 1062, the new Oklahoma workers' compensation law passed earlier this year. Senate Bill 1062 replaces the existing court-based workers' compensation system with an administrative scheme and introduces a workers' compensation option for certain employers.


09/03/2013 -- WHAT'S AT THE CENTER OF A SUCCESSFUL NONSUBSCRIBER PROGRAM?

There’s an ongoing debate as to what is the most important part of a Texas nonsubscriber program. Some say it’s the injury benefit plan because, without a plan, the employer would be hard pressed to deliver injury benefits in a fair and consistent manner. Others say insurance is the most important component because it provides medical, wage and in some instances, legal defense costs and damages. While still others believe an effective safety program is at the heart of any successful nonsubscriber program.

07/03/2013 -- OBAMA ADMINISTRATION DELAYS EMPLOYER MANDATE UNDER HEALTHCARE LAW

The Obama administration announced late yesterday that it will delay a key provision of the Affordable Care Act, which requires employers with 50 or more full-time employees to provide health benefits or pay a fine.


06/06/2013 -- TXANS RELEASES END OF LEGISLATIVE SESSION REPORT

The Texas Association of Responsible Nonsubscribers or TXANS leads the effort to promote the use of sound and ethical practices relating to the provision of quality workplace injury benefits by nonsubscribers to workers’ compensation. One of the many services TXANS provides its members is an annual report on its legislative activities. The 83rd session of the Texas legislature adjourned last week and here is a summary from TXANS’ most recent report.


04/25/2013 -- OKLAHOMA HOUSE OF REPRESENTATIVES APPROVES LEGISLATION ALLOWING ALTERNATIVES TO WORKERS' COMPENSATION

Driven by the success of responsible nonsubscriber programs in Texas, the Oklahoma House of Representatives approved legislation yesterday that would allow employers to provide other types of injury benefits as an alternative to workers' compensation insurance.


04/24/2013 -- DEADLINE FOR TEXAS NONSUBSCRIBER FORM 5 FILING IS APRIL 30TH

Texas employers that do not carry workers’ compensation insurance, and whose employees are not exempt from coverage under the Texas Workers’ Compensation Act, are required to file a DWC Form-005, Employer Notice of No Coverage or Termination of Coverage on or before April 30th of each year.


04/03/2013 -- TXANS AWARDS RESPONSIBLE NONSUBSCRIBER™ CERTIFICATION TO THE WORKPLACE INJURY BENEFIT PROGRAM OF DEAN FOODS

Austin, Texas - The Texas Association of Responsible Nonsubscribers (TXANS) announced today that it has awarded Responsible Nonsubscriber™ certification to the workplace injury benefit program of Dean Foods.


02/28/2013 -- NEW LEGISLATION WOULD REQUIRE NONSUBSCRIBERS TO DISCLOSE INJURY RELATED CLAIM & FINANCIAL DATA

Specific requirements include the cost of medical treatment, wage replacement benefits and any settlement amounts.


02/27/2013 -- USING ACCIDENT RECONSTRUCTION MODELS TO STRENGTHEN YOUR NONSUBSCRIBER CASE

Identifying the type of accident that occurred is a relatively simple task; however, determining which standards apply, the root cause of the accident and ultimately who’s at fault and who’s not remains a daunting challenge.


12/17/2012 -- TEXAS WORKERS' COMPENSATION NONSUBSCRIBER REPORTING REQUIREMENTS CHANGE ON JANUARY 1

Effective January 1, 2013, Texas employers who do not carry workers’ compensation insurance coverage have new requirements for reporting their non-coverage status to the Texas Department of Insurance, Division of Workers’ Compensation (TDI-DWC) and to their employees.


10/09/2012 -- NOTIFICATION REQUIREMENTS FOR OF BENEFIT PLAN MODIFICATIONS

Many nonsubscriber workplace injury benefit programs fall under the auspices of the federal Employee Retirement Income Security Act or ERISA.


09/17/2012 -- NEW TEXAS PRIVACY LAW IMPACTS NONSUBSCRIBERS TO WORKERS' COMP

A new law (oftentimes referred to as the Texas Medical Privacy Act) became effective on September 1, 2012. The law requires covered entities to protect the privacy of health records or protected health information (PHI).


08/03/2012 -- TDI-DWC ADOPTS NEW REGULATIONS FOR TEXAS NONSUBSCRIBERS

The Texas Department of Insurance, Division of Workers’ Compensation (TDI-DWC) adopted new regulations pertaining to businesses that operate as nonsubscribers to the workers’ compensation system. The new and revised regulations represent the most significant change to nonsubscriber regulations since the major re-write of the Texas Workers’ Compensation Act more than 20 years ago.

02/11/2011 -- OSHA ANNUAL SUMMARY AND REVISED NONSUBSCRIBER FORMS

February 1st is the deadline for a couple of filing requirements that relate to your nonsubscriber injury benefit program.


01/14/2011 -- TEXAS LEGISLATURE CONVENES

The 82nd Legislature convened at noon today in Austin and as lawmakers gear up for the 140 day legislative session, growing transportation needs, immigration, redistricting and huge shortfalls in the state budget should prove to be some of the more pressing issues. State Comptroller Susan Combs released preliminary numbers this week estimating a budget deficit of at least $27 billion dollars.


10/02/2010 -- TXANS INTRODUCES VIRTUAL LEARNING PROGRAMS

Issues that impact the workplace continue to grow at a record pace amidst rising travel costs, limited travel budgets and increased time restraints. To help TXANS members satisfy their thirst for education while addressing the need to conserve costs, TXANS is introducing a new series of Virtual Learning programs that will offer the same quality content but without the added costs and time expenditures associated with traditional meetings.


07/18/2010 -- TXANS AIDES MEMBER EMPLOYEES AFFECTED BY RECESSION

While the impact of the recession has not been as severe in Texas as it has in other states, some employees of TXANS member-businesses have lost their jobs due to prolonged economic uncertainties.


05/10/2010 -- NEW TEXAS EMPLOYER REPORTING REQUIREMENT

During the last legislative session lawmakers passed House Bill 2360 amending the Texas Labor Code to require employers to provide employees with information regarding the earned income tax credit (EITC). More specifically, the Texas Workforce Commission’s EITC rule requires employers that employ at least one person to give every employee ‘information regarding general eligibility requirements for the federal earned income tax credit” no later than March 1 of each year. The EITC rule will likely require employers to utilize IRS Notice 797 to meet notification requirements.


03/06/2010 -- MEDICARE REPORTING REQUIREMENT DEADLINE EXTENDED

The Medicare, Medicaid and SCHIP Extension Act (the Act) applies to employers (both subscribing and nonsubscribing), insurance carriers, third party administrators, attorneys and more. The purpose of the Act and the related Medicare Secondary Payer (MSP) rule is to prevent employers, insurers and others from shifting financial responsibility for certain claims to the federal government.


01/31/2010 -- OSHA PROPOSES RECORDKEEPING CHANGE TO INCLUDE MUSCULOSKELETAL DISORDERS

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) is proposing to revise its Occupational Injury and Illness Recording and Reporting (recordkeeping) regulation by restoring a column on the OSHA Form 300 to better identify work-related musculoskeletal disorders (MSDs).


11/03/2009 -- NEW EEOC POSTER

The Equal Opportunity Employment Commission (EEOC) has revised its “Equal Employment Opportunity is the Law” poster to reflect the most current provisions of employment discrimination law, including the 2008 amendments to the Americans with Disabilities Act.


10/01/2009 -- TXANS PROGRAM EXPLORES NEW FEDERAL REPORTING REQUIREMENT

On September 17 the TXANS hosted an educational forum to aide nonsubscribing employers and industry professionals with new reporting requirements under Section 111 of the Medicare, Medicaid and SCHIP Act.


09/01/2009 -- TXANS PARTICIPATES IN NATIONAL PREPAREDNESS MONTH

During the month of September TXANS will again be participating in National Preparedness Month (NPM). NPM is a nationwide effort sponsored by the Ready campaign that is designed to increase emergency awareness and encourage individuals, families, businesses and communities to take action and prepare for emergencies.


07/27/2009 -- NEW TXANS SERVICE HELPS EMPLOYERS AVOID COSTLY PENALTIES

Businesses that operate as nonsubscribers to the workers’ compensation system are subject to several regulatory requirements. Unfortunately, the consequences of cost of non-compliance can be significant. For example, the Division of Workers' Compensation who has regulatory authority over nonsubscribers reports that failure to comply may result in enforcement action and administrative penalties of up to $25,000 per day, per occurrence.


06/11/2009 -- NONSUBSCRIBERS REQUIRED TO PROVIDE WRITTEN NOTICE TO EMPLOYEES

Texas nonsubscribers are required to post and file various forms and notices in connection with their nonsubscriber but it is important to remember that nonsubscribing employers must also notify employees of heir coverage status.

01/28/2009 -- OSHA POSTING DEADLINE APPROACHES

Covered employers must post their OSHA Form 300A also known as the Summary of Job-Related Injuries & Illnesses on or before February 1, 2009. The Form 300A summarizes recordable workplace injuries and illnesses from the OSHA Form 300, also known as the OSHA Log.


12/16/2008 -- TXANS PROGRAM HELPS NONSUBSCRIBERS IMPROVE WORKPLACE SAFETY

The General Industry Training Program provides training in pertinent health and safety topics and is tailored for employees, management and other supervisory personnel at nonsubscribing businesses. The program has become a widely known standard for OSHA orientation training and implies a certain level of safety training.


09/11/2008 -- TXANS HELPS BUSINESSES PREPARE FOR POSSIBLE HURRICANE

With the increasing possibility that Hurricane Ike may impact Texas, preparations should be underway to protect employees, customers and property at Texas businesses that could be impacted by the storm. To support these efforts the Texas Association of Responsible Nonsubscribers (TXANS) is pleased to provide a Hurricane & Storm Preparation Checklist.


06/04/2008 -- PENALTY DEADLINE SET FOR NONSUBSCRIBER REPORTING REQUIREMENT

The Texas Department of Insurance Division of Workers’ Compensation (DWC) reports that administrative penalties will be levied against nonsubscribing businesses that have not filed the Employer’s Notice of No Coverage or Termination of Coverage (DWC Form-005) beginning on June 6th.


05/02/2008 -- NEW PROGRAMS PROVIDE INSIGHT ON NONSUBSCRIBER INJURY BENEFIT PROGRAMS

05/02/2008 -- TXANS AND OSHA FORM ALLIANCE FOR TEXAS NONSUBSCRIBERS

The Texas Association of Responsible Nonsubscribers (TXANS) and the Occupational Health and Safety Administration (OSHA) have formed an alliance to provide Texas nonsubscribers with information, guidance, and access to training targeted at reducing and preventing workplace hazards.


03/10/2008 -- NEARLY FOUR HUNDRED PARTICIPATED IN TXANS 18th ANNUAL NONSUBSCRIBER CONFERENCE AND EXHIBITION

Nearly four hundred participated in TXANS 18th Annual Nonsubscriber
Conference & Exhibition last week in Austin, Texas. TXANS Annual
Nonsubscriber Conference & Exhibition is the nation's largest event for
employers that provide occupational injury benefits outside of workers' compensation.


01/30/2008 -- EMPLOYERS MUST POST ANNUAL INJURY & ILLNESS SUMMARY ON FEBRUARY 1st

The Occupational Health and Safety Administration (OSHA) requires covered employers to post the OSHA Form 300A, Summary of Work-Related Injuries and Illnesses, by February 1st. Information is drawn from the OSHA Form 300, Log of Work-Related Injuries and Illnesses which is used throughout the year to classify work-related injuries and illnesses, noting the extent and severity of each case.


12/03/2007 -- NEW FEDERAL RULE REQUIRES EMPLOYERS TO PAY FOR EMPLOYEE PERSONAL PROTECTIVE EQUIPMENT

Many Occupational Safety and Health Administration (OSHA) standards require that employers provide employees with Personal Protective Equipment (PPE) when necessary. These standards address many kinds of PPE like hard hats, gloves, goggles, safety shoes, safety glasses, welding helmets and goggles, chemical protective equipment, fall protection equipment, and so forth.


12/03/2007 -- EMPLOYERS MUST TRANSITION TO NEW EMPLOYMENT ELIGIBILITY VERIFICATION FORM

The U.S. Citizenship and Immigration Services section of the Department of Homeland Security has introduced a revised Employment Eligibility Verification Form (Form I-9), which employers must begin using no later than December 26, 2007.

06/14/2007 -- NONSUBSCRIBERS SHOULD CONSIDER "EARLY WARNING" SAFETY SYSTEM

Nonsubscribers can adopt an early warning system to help forecast potential injuries by requiring employees to report all “near hit” incidents. Near hits are unexpected events that nearly result in a workplace injury. For example, safety equipment that doesn’t perform as expected, objects stacked improperly that fall and nearly hit an employee or a slip and fall that does not result in an injury.

04/08/2007 -- TXANS HELPS EMPLOYERS WITH REPORTING REQUIREMENTS

In an effort to combat recent allegations that Texas nonsubscribers are failing to comply with state requirements for nonsubscribers, TXANS is accelerating its effort to increase awareness of reporting requirements and assist employers with injury reporting.


03/27/2007 -- TXANS TESTIFIES AGANST BILL TO REQUIRE NONSUBSCRIBERS TO RELEASE CONFIDENTIAL INFORMATION

Yesterday TXANS testified before the House Committee on Business & Industry in opposition to House Bill 1772 because it would require nonsubscribers to submit sensitive financial data related to employee injuries with no specific restrictions on how the information would be utilized.


01/29/2007 -- EMPLOYERS MUST POST OSHA SUMMARY BY FEBRUARY 1ST

Employers must post OSHA's Form 300A - Summary of Job-Related Injuries and illnesses by February 1, 2007. The Form 300A summarizes recordable workplace injuries and illnesses and should not be confused with the OSHA log or Form 300.

11/15/2006 -- BILL FILING STARTS AT TEXAS CAPITOL

Monday was the first day Texas lawmakers could file legislation in preparation for the 80th regular session, which is scheduled to convene on January 9, 2007. Three hundred thirty eight bills have been filed so far and several relate to Texas employers.

01/01/2006 -- NEW LAW REQUIRES CERTAIN BUSINESSES TO ADOPT INJURY CONTROL PLANS

Effective January 1, 2006 Texas hospitals, including general or special hospitals, private mental hospitals, licensed a nursing homes and others are required to adopt and implement policies to identify, assess, and develop strategies to control the risk of injury to patients and nurses associated with the lifting, transferring, repositioning or movement of patients.


11/25/2005 -- NEW LAW AFFECTS BUSINESSES THAT CHOOSE TO OPERATE WITHOUT WORKERS' COMPENSATION COVERAGE

The Texas Association of Responsible Nonsubscribers (TXANS) reports that businesses that elect to operate as nonsubscribers to the workers’ compensation system should review their injury benefit programs to make sure they are in compliance with new provisions contained in the most recent workers’ compensation reform law that became effective on September 1, 2005.

A report entitled, Legislators Guide to the Issues 2005-2006 was issued today by the Texas Public Policy Foundation (“TPPF”) during its 3rd Annual Policy Orientation for the Texas Legislature. The terms self-insurance and self-insured are sometimes used to define businesses that are certified to self-insure their workers' compensation program or nonsubscribers that self-insure their occupational injury benefit program. While both programs involve employers "self-insuring" occupational benefits, there are important distinctions to be made.

08/19/2004 -- NEW REPORT REVIEWS THE POSITIVE ROLE OF COMPETITION IN HEALTH CARE

The Federal Trade Commission and Department of Justice issued a joint report, Improving Health Care: A Dose of Competition, which culminates a two-year project. The report studies the role of competition in the health care industry and provides recommendations to improve the balance between competition and regulation.


08/19/2004 -- LIEUTENANT GOVERNOR ANNOUNCES ADDITIONAL INTERIM CHARGE ON WORKERS' COMPENSATION

On the heels of new numbers from the Texas Department of Insurance showing that workers' compensation insurance carriers are charging higher premiums even though claim costs are decreasing, Lieutenant Governor David Dewhurst announced today an additional interim charge to study the pricing of workers' compensation premiums in Texas.


06/10/2004 -- STATE TO CONDUCT SURVEY OF NONSUBSCRIBING BUSINESSES

Texas A&M University is conducting a survey of nonsubscribing businesses for the Texas Department of Insurance. Data will be used by the Texas Legislature.


06/01/2004 -- ERISA FILING REQUIREMENTS FOR NONSUBSCRIBER INJURY BENEFIT PLANS

ERISA requires a welfare benefit plan to file an Annual Return/Report of Employee Benefit Plan (Form 5500) and any required attachments by the end of the 7th month following the end of each plan year.

The U.S. Department of Labor, Internal Revenue Service and the Pension Benefit Guaranty Corporation jointly developed the forms so employee benefit plans could utilize the Form 5500 to satisfy annual reporting requirements under Title I and Title IV of ERISA and the Internal Revenue Code.


06/01/2004 -- MEDICAL PROVIDERS TURN TO NONSUBSCRIBING BUSINESSES

Decreased fees and increased regulation have prompted medical providers to join the growing list of interests frustrated with the Texas workers' compensation system. And in response to their concerns, an increasing number of providers are not only discontinuing treatment of workers' compensation patients (leaving some rural areas of Texas without options for care) but also increasing efforts to attract business from nonsubscribing employers.
